Now, it's Red Eye Radio, Gary McNamara, and Eric Hurley,
“talk about everything from politics to social issues, and views of the day,”
whether you're up late or you're just starting your day. Welcome to the show from the Relief Factor Studios. This is Red Eye Radio. All across America, we are Red Eye Radio. He is Eric Hurley and I'm Gary McNamara.
Welcome in good morning. You know, you're just telling me the story that was out there yesterday, the process to refund tariffs to begin next week. Yeah. The Trump administration is expected to start accepting claims next week for refunds
from tariffs. In an order Tuesday, Judge Richard Eaton of the Manhattan Base Court of International trades at the government confirmed in a closed conference earlier in the day that it's on track to begin processing claims for refunds with interest on April 20th for some importers.
The refund claims that the government said it can start accepting
amount to $127 billion of the $166 billion
the government collected in tariffs that were invalidated by the Supreme Court in February.
“U.S. customs and border protection has been working to build a system”
to handle refunds after Eaton directed it to immediately begin the repayment process on March 4th. But he ultimately gave the Trump administration more time after he said its current system was incapable of reimbursing for more than 53 million imports that were affected by Trump's tariffs.
More than 3,000 lawsuits have been filed at the trade court by companies seeking a refund. The Supreme Court left it to the trade court to figure out if and how importers would get their money back. After it said Trump lacked the authority to issue the tariffs under the
International Emergency Economic Powers Act, the refund process was initially expected to be hashed out in a case filed by atmospheric technologies until the National Tennessee company last week voluntarily dismissed.
It's claimed for an $11 million refund.
The company decided no longer wanted to be the public face for the mass scramble for repayments according to people familiar with their discussions. Antimissible Tracion did not respond for several requests for comment.
By the way, you don't have to file suit. No, the court said it was not necessary. And so there is also that outside of those that can use the automated process, there are others who cannot. Some entries that haven't gone through a formal close
out step, they call that liquidation, by the way. And are subject to anti-dumping orders must instead go through a manual administrative process. Oh, that won't take forever. That requires additional steps.
And they said that that applies to according to CBP
about $2.9 billion worth of tariffs,
that need refunding. So there's going to be that part of the process. Again, that's going to be a lot slower and not part of the automated process. But the CBP basically went back to the trade court
and asked for an extension thing. We need 45 days because the judge said, look, you already do this. You already have the liquidation process to reconcile everything in place.
You just need to use that. And they said the CBP came back and said, well, actually, not at this level, we don't. So we need 45 days in the judge allowed that. And that's where we are.
And they're hopeful CBP believes they can start that process next week. And we'll see where that goes.
“Did we know what the amount of interest is going to be?”
I don't. It's. I thought we had a figure. Yeah, I don't. Yeah, you mean the overall amount total?
Yeah, what if it was estimated by the judge? Yeah, I don't remember. Okay, they if it was 175 billion. They say not 127. But it was 700 million per month.
So if it's 170 75, what is it then? It might be 550 million a month. Is what the taxpayer is. Yeah, yeah, yeah, yeah. The the companies for the tariff.
So yeah. So if you look at that 550 million per month, if that is. You apply that to a month and a half, then you get closer to 700 million. Well, yeah, multiply it by 12 because well, multiply it times 11. Right.
So that would be 5.5 billion the taxpayer. Oh, 11 months total.
Right.
Yeah, I was accounting for the the extra 45 days, which the judge also said, That's, you know, okay. Well, well, I'm talking about if it was paid today. Right. Yeah. But no, if it's not paid till next month, it would be 13, it would actually be 13 months. Because it was April when the tariffs went into effect.
Yeah.
And so it might be six billion dollars.
That so the tariffs have actually cost the American public. And extra six billion. And that 45 day extension costs more interest.
“Yeah. So that's why I put that twice a 13.”
Right. Right. And so that that. And I don't know that the court addressed for those unable to use the the the the automated system. They're going through the manual approach here.
Then because that takes longer is there at when the settlement comes in when the liquidation process is complete. Do you go up to that date because it's taking if if it takes them longer, the ones who cannot use the automated process. I would think that would happen to apply it to all of them doesn't matter. It's like your your the government owes you a tax refund and doesn't pay you on time. Or let's reverse it.
If you don't pay on time, the the government doesn't care why today's the day right the it's the the day that it's paid off is the day that the interest stops. Right. And so and so the new the new tariffs, which I believe is a stronger legal case than even the last one, which was an extremely strong case.
That's expected to raise what by July or August another 40 billion and if that has to be paid back.
There'll be interest on that, which means you know whenever that would be resolved the total interest the American public. Ex has to pay extra. This is the American public these are companies right this comes out of income this comes out of income tax. It's out of the treasury could could reach $10 billion. Yeah.

That's the money. Remember you can afford anything just not everything afford anything. Follow and listen on your favorite platform. Um now the the good thing is. And we didn't get a chance to talk about it yet.
So much happened over the weekend. But the inflation numbers came out and the initial report looked bad. But three quarters of the inflation was gasoline and fuel oil. Yeah. And it was also priced in by the market that it hit spot on us to where the market thought it was going to be.
But if you look at it, you actually had a decrease in the inflation rate. And I looked at you and said nobody mentioned it. But tariff stopped and February 20. So from the the 10% were put in. But they were lowered from what they whatever they were for each country.
That the president decided what he wanted to tariff each country.
“But the tariff rate came down to a 10% is that why prices lowered.”
Could be. That could be because it was actually a good it was outside of it. I mean the the media was promoting it was that it was horrible. But it was actually a decent number. And you had a ton of products that were beneath the 2% rate.
That the Fed is looking for. So if it's just gasoline there, you know, we we have said. That the best thing for Republicans. Uh, would be, you know, once this ends and. You know, again, a ran for example.
The block eight is really interesting because. You know, we're we have, you know, their ships coming over here now. It's not going to lower the price because ships are coming over here to get oil. All right. We're still going to be importing.
It might even possibly increase West Texas intermediate. Possibly. It's down right now. It's down to 91. Right.
But that's based on possible talks in the president telling Maria Bartiromo that he believes that the end of the war is close. Right. And if that does, that will be a great relief. Yeah. My 401k will love it.
You know, I said my 401k is if I'm never going to be able to collect facts.
I'm never going to stop. Well, I do have to take the. Oh, yeah, mandatory distribution now in two years. Could you extend it a couple more years? By the way, that's a great incentive to continue working.
Yeah. Well, they said no man mandatory distribution. We're going to raise to 75.
They're not going to do that because they want Gary's money.
Oh, they want the taxes. Yeah.
They want Gary to pay tax on that money.
Yep. It's all about me. Right. Oh, yeah. No, it's the focus is on you.
Yeah.
“So, but the the best thing now that the again.”
When I saw last week that when it was at the Fox, I forgot who it was. Who did the polling that showed the Republicans and Congress. You know, the Democrats are so bad that Republicans actually had the favorability lead in Congress. It's like, wow. And that's the Democrats or the Republicans best hope is the Democrats.
I hope that holds till November. And it's quite possible. But if you know, if the president can get a if they get a P steel, you saw the president.
You see what the president said yesterday.
Hmm. I don't like what my negotiation grows. Negotiator said we agreed to a 20 year deal. No, we won't. It's forever.
Yeah. Went. And then I thought to myself, are you guys communicating with the president? Well, that shouldn't be coming out before you communicate with the president. Yeah.
Because I looked at a 20 year deal less than a 20 year deal is forever. What you're hoping for is eventual regime change. You know, one year is a good if if again. The conditions are right. But I, I don't know what happens with uranium stockpiles in Iran.
There, that has to be turned over. Oh, yeah. Yeah. Well, that otherwise I deal is not a deal. I'm thinking and has everything changed.
Look, when, when we talk about. What we don't know. And. You and I disagree with the media out there that says, well, they didn't plan this and they didn't plan. They have plans and they do more games for everything.
Yeah. They do simulations for everything at the Pentagon. Mm-hmm. Everything has been considered. Mm-hmm.
“But have they looked at this and realize the impact that the blockade's going to have?”
And does a CIA know that this is what is going to work? And so Mr. President, you don't need to compromise. You can get whatever you want. And if there isn't a war happening. Because the president said, I don't see that we're going to extend the cease fire.
Right. Well, you can let the cease fire go and still not do anything if the blockade is working. Yeah. The or just take out, you know, occasional things that might be, you know, you think need to be taken out or have Israel do that.
But if the cease fire is any, doesn't mean you necessarily have to go back to war. Yeah. And so you just say, now the cease fire, we believe we've got the edge here. Most of what I've read from people that I actually thrust has said this is going to be massively devastating to Iran. And immediate.
Oh, yes. You will have an immediate note already having an immediate impact. No doubt. There, which I think was a great move by Trump and a great plan by the Pentagon. Yep.
Yep. This, this will choke them out. And then there is no. I mean, the Wall Street Journal had this weird, I don't want to call it weird. But it was an interesting story yesterday about the new regime is even more hard line than the other
regime. Yeah. And it's like, well, it doesn't matter if they don't have the ability. If you're talking about a handful as opposed to their former leader being killed. The Iotolis senior, and now it's Iotola Junior and a handful.
Tell me what they have the ability to do. They haven't changed in what they believe. I get that. But they're not stronger. And that was the implication from the story.
And I thought, well, no. It was always going to be a getting to the last of the loyalists of the regime was always going,
it's always the toughest part of it and taking them out because you, you don't first of all,
you don't know who's who. And I really believe that this ceasefire is giving them the, and the talks. And he, the president said there could be more talks here in a day or two or, you know, that gives Intel more time to work.
“And I think that's going to be the key to again, getting that stockpile,”
whether we go in and take it, whether it's destroyed, whether whatever it's going to be, or whether they hand it over. I think that's going to be the key. If the president get a peace deal in the next couple of weeks. And it looks like he's playing hardball right now and gets what the consensus would be.
And I don't mean the insane left with the consensus, you know,
From from the, the right and the center that this is a great thing.
And it's a great deal.
And this will really, really change things in the Middle East.
And then the president comes in and says, look, I know the Supreme Court's going to really against me on the 10% terrorist. Well, they're gone and prices come down. They got a shot. Yeah. They got a great shot in November,
especially if the Democrats keep imploding. Right. Yeah, they do. But this could be kind of a double boost. You know, if you look at it in terms of the economy,
“the war coming to an end if that's what happens.”
And then the terror thing just going away because the 150 days is going to happen. It's going to happen before then. And it could be enough boost to just let it ride through November. But on top of that,
the sentiment by the American people that the elect is just gone overboard.
They're too crazy. And then people throughout the United States and throughout the world will all be holding up signs. Trump is God. Yes, they will. I think starting with the one.
I think they will. You'll see that a lot on TikTok people. If he doesn't the Middle East, I'm telling you. It's one of the.
Oh, if he gets the the the, I don't know what you're going to do with the regime. Right.
“But what they've done so far to disable,”
then if you can if you can get the, you know,
stop the Iranian enrichment and get a deal that is absolutely slammed
in the United States. It's been a long time. And it's been a long time. And it's been a long time. And it's been a long time.
And it's been a long time. And it's been a long time. And it's been a long time. And it's been a long time. And it's been a long time.
And it's been a long time. And it's been a long time. And it's been a long time. And it's been a long time. And it's been a long time.
And it's been a long time. And it's been a long time. And it's been a long time. And it's been a long time. And it's been a long time.
And it's been a long time. And it's been a long time. And Democrats did mind that he was keeping that he was keeping in the Democrats were all for keeping a ran flush with cash even though they were giving money to the proxies to kill Americans and Western interests Democrats didn't care. Right. So you don't know what's going to happen in two and a half years.
Right. Exactly.
“I think, by the way, there could be a political play to say, OK, we came to an agreement.”
But also behind the scenes, you're working toward regime change. Yes. And Israel's doing heavy lifting, so you can get through November. But you can still accomplish your goal. We are right.

“And he is here currently and I'm Gary McNamara.”
Welcome and good morning. Thank you so much for being here.
Well, a federal appeals court delivered an embarrassing decision to U.S. District Judge James Bozberg on Tuesday ordering him to shut down his quote intrusive criminal contempt of court investigation against the Trump administration. The U.S. Circuit Court of Appeals for the District of Columbia said Judge Bozberg's continued investigation is in proper and his reasoning for pursuing contempt of court prosecutions for Trump officials is a dead end quote.
“A dead end because the judge is misleading his own orders.”
As we had said from the very beginning that's getting involved in places where he had no business getting involved.
Right. Circuit Judge Naomi Rao said Judge Bozberg has crossed too many lines risking damage to the separation of powers between the president and the court. She said Judge Bozberg must end his pursuit of the president and his team. As the shifting and expanding proceedings demonstrate, the district court has assumed an improper jurisdiction antagonistic to the executive branch. Oh, that's a quote.
He said Judge Rao. She was joined by Judge Justin Walker. The case is he latest fallout from Trump's effort last year to use the alien enemies act to deport Venezuelan gang suspects.
Three plain loads of migrants flew out of the U.S. and March 15 heading for El Salvador where they were put into a terrorist prison in the passengers on the flight where split between Venezuelans deported under the 1798 enemies law and citizens of Salvador being sent back home. Among them was Kilmar Garcia in a snap hearing. Judge Bozberg issued a temper restraining order and tried to recall the flights. Then he wrote an order halting the deportation of anyone still in the United States. He said he thought his orders were clear, but Judge Rao said Tuesday.
They were not clear enough in his written orders conflicted with his oral order during the hearing. That she said left enough room for the government to carry out the flights that had already left. Judge Walker noted the Judge Bozberg told the attorneys not to bother writing down his oral instructions because he would issue a written order. The written order lacked the instruction to recall the flights already in the air and apply to only those still on U.S. soil. Judge Walker said the government had faithfully followed that written order undercutting Judge Bozberg complaints.
The Supreme Court eventually vacated Judge Bozberg's initial ruling anyway. Well, Judge Bozberg insisted that his order should have been followed at the time, even if it was legally wrong. He initiated a criminal contempt of court investigation and demanded no who made the decisions to continue the flights. A whole former Homeland Security director Christi Nome said she was the decision maker, but Judge Bozberg said that wasn't enough. He has prodded for more information with the goal of turning everything over to prosecutors to pursue a criminal case for violating his orders.
The circuit court told him give it a rest. The quote, the district courts widening an unnecessary inquiry into executive branch decision making conducted on an erroneous premise that the temporary restraining order is sufficiently clear and specific is at least a clear abuse of discretion Judge Rao wrote. Yeah.
“Remember, just four days before issuing the orders of the deportation case, Judge Bozberg was part of a session of federal judges during which he reportedly raised the idea.”
Remember this that the president would disregard rulings of federal courts and create a constitutional crisis. We know he's going to break the law he hasn't, but we know he's going to, but we know we will, right, therefore we need to do these things to stop him even there.
That's not in our powers as judges.
No.
“They care nothing about that they don't care anything about the separation of powers.”
This is about controlling the executive branch at every move because you don't like Trump.
Abigail Jackson, White House postperson, cash judge Bozberg, it's a file-up judicial activist trying to undermine the president's awful authority. The American Civil Liberties Union, which represented the migrants deported on the planes criticized a ruling as a blow to the rule of law, of course they would. You had, let me see here, Josh Blackman, a professor at South Texas College of Law. This is from the Washington Times, by the way, said the competing interpretations of Judge Bozberg's ruling are proof that the Trump administration was not intentionally violating the initial order.
The entire content process has been something or crusade by Judge Bozberg who obviously feels like he was personally wrong. Yeah. Yeah. Yeah. That was a beat down, actually.
I mean, read it always. Yeah. It's a beat down. Yeah, it really was. But again, pure activism from the bench.
But we've seen this.
Bozberg's not the only one on the bench.
We've seen this time and time again from other judges who believe they're going to go in. This is their job to go in and stop Trump. They don't care about the Constitution. They don't care about the separation of powers. This is their job to be an activist and right in order.
We'll just write the order. That should be a new sign for all the episode. They just write it off. They just write the order. It doesn't matter that the order doesn't actually have anything to do with the Constitution.
They'll just write the order. You know what I thought was interesting yesterday was the the the the back and forth. And these these are everybody that I read were, you know, conservatives. Many Christians, many Catholic.
“Well, versed on the Bible, who said, what is Pope Leo talking about?”
Yeah.
The Bible is not pacifist.
The pacifist is not a pacifist document. Right. The word is justified. Just wars are justified. You know, it's what we said before.
And the problem with Leo did. And the reason and the the mainstream media is like, Oh, this is going to be a big thing in the election. No, it won't. That's not a needle because it's it's a conversation. Right.
That doesn't have anything beyond the conversation. It's it's a conversation, but when you get down to forget about the whole. Well, you can't forget about you can't forget about the Bible because it's funny. Because I think it was a rich lottery. Rona column.
I think it was in the near post. It was in it was in a national review and everything. Trump versus the pope. And he goes through, you know, he goes through all the different scriptures. They talk about war being justified.
Yeah. Right. And that's the problem that Pope Leo had. He made it seem like all war was wrong. Right.
Right. And he was bringing in idolatry as if on the idolatry was to Trump and not bringing up. And they talked about that when Trump really talked about going into Iran. It was after the massacres were happening. Yeah.
That's when he really up. Right. And they're like, we have no idea where he's going. Is this, you know, and that's the allegation goes the allegation becomes more credible. These just to far left Marxist in there.
By the way, just what people know, I'm Catholic. I understand Catholicism. And I absolutely shocked by what he has done. The one interesting thing, you know, we talked about how when it comes to, you know, the, you know, the morality of the, of the doctrine that the pope is infallible.
What I thought was really disingenuous was the Vatican trying to make the case that his opinion on the war was infallible. Right. Yeah. Yeah.
“I think probably a lot of Catholics had problems with that saying, no, stop it.”
You're not mentioning Iran. Right. You know, it's like Tom Holman saying that when he talked about immigration, when he criticized it and he just said, I'd like to go to the, I'd like to go there. I'd like to go to the Vatican or have one of our representatives go to the Vatican.
Holman said it and tell him about, you know, the children being raped. Right. Right. It's like it's almost as if you said, I'm Catholic and I'm Catholic and I'm a, you know, a, you know, practicing Catholic and he said, it's like they don't even know it's going on.
Right.
As if they're ignorant or willfully blind as to what evil is. And that's the other thing that came out. Why is the pope not recognizing where the true evil has been and has been for decades upon decades. Well, it's a legitimate point.
Well, you're, you're, you're leaving out the most critical part of all of these equations.
The war with Iran. And, and enforcing our borders and getting the violent criminals out of this country. And, and I'll, and I'll say this too. And it may be unfair because this, this is not an indictment of Leo in this case. But as an indictment of the pre scandal over the decades and how it was hidden.
And so when that happened, the Catholic Church lost a ton of credibility. Yeah. Fairly or not. I mean, that's just a reality of, of how, of how people think. And that affected Catholics deeply.
You know, you go to places that are hugely Catholic. You know, Western New York where I'm from. All these churches are closing down. Now, I did see you see that more people are, you know, during Easter that really over the last couple of years.
More people are coming to Catholicism.
Mm-hmm. Wow. But the churches are closing down. Mm-hmm. Diasis, they have to, they've got to sell the real estate because of all the lawsuits.
Yeah. And there are Catholics that feel betrayed, not by Catholicism. No. But by the people that were in charge of the church. Right.
And so they look at it and it's just like, well, you know,
“and again, it might be, I think it's unfair to, to throw this under Leo.”
But, you know, to throw this at, you know, Pope Leo. But when you look at overall the Catholic church, it is a legit concern.
Do you have moral credibility, not not the doctrine of Catholicism.
But the human beings that are running it that are fallible. Right. You know, you know, you know, we look at it and say, you're not credible. You're the problem. And I know that because I saw the debate when the pastor at my parents' church,
I was there when he announced his retirement. And I'd known him for years. My parents knew him. And everybody was shocked and it was so sad. Yeah.
I've decided to retire now two weeks later. He's on the list. Mm-hmm. Yeah.
“And the people of that church are left wondering, what do we do?”
Because I look at that from the outside, not a Catholic, but from the outside of the people sitting in the church. And nobody's at the helm. Because again, they're on the list. And now they're left to ask why wasn't something done.
Why didn't church leadership do something about this? And it went on for years. And now the credibility has gone with leadership. The Pope not bringing up the brutality and how evil the Iran regime has begun, not mentioning that in his statement has heard his credibility among Catholics.
Yeah. Yeah. Again, you're leaving out the biggest part of the equation of what the goal was and really what triggered this set of events of the U.S. going after a rant. And that is the regime killing tens of thousands of their own people.

They say, stand in front of a camera and you walk right through. Hey, Gary, how are you?
“Now you have to do it to American Airlines.”
You put in your passport on the app and you put in your passport and you're, you know, your passport and your TSA pre-check. That's all you need. And just walk right through. And now American Airlines at their new gates.
There's 20 gates to be installed at Terminal A. They're being installed right now at Terminal A and Terminal C. You've been there, you've seen the construction. They're going to open by mid-2026. 20 new gates will have electronic boarding gates.
That's where they're going.
Interesting. All right.
Everything will be automated.
You'll board the plane electronically.
“You're not going to have that person that scans it.”
Right. Because now, most people just hold their phone over it. And they don't even, so that person is only saying, you know, OK, group one, group two. You can have an automated announcement.
Yep. It'll be a touch screen instructions and automatic validation of boarding passes. The initiative aims to reduce congestion and improve traffic flow on the jet bridge,
making American Airlines the first major carrier to implement electronic boarding gates at
Major Airport at a major airport. They've been doing a testing on it. They say the customers like it. Right. Now, those still be people at the gate.
They've got to do the announcements. Yeah. They've got to remember.
“If your planes are always sold out, so they've got to make sure that some of the carry-ons”
Right.
You know, don't get carried on.
Right. Right. Yeah. They're still going to be there doing that. This is Rida, radio.
